Councillor hopes to solve fence mystery

A COUNCILLOR has stepped in to help residents find out who has installed a mystery new fence on deserted land in Acomb, York.

Residents in Runswick Avenue contacted Coun Tracey Simpson-Laing about the grassed area near to the junction with Beckfield Lane, where a fence has recently appeared. People approaching the workmen putting up the fence were told developers Hogg The Builder had commissioned the fence.

Coun Simpson-Laing said residents were confused as they had thought the land belonged to the City of York Council. She said: "I asked council officers to look into the matter, and it seems that after looking at both their records and those of the Land Registry, that no one is registered as owning the land. Officers have informed me that if Hogg The Builder were responsible for putting the fence up around the piece of grass, from an enforcement angle' there is nothing that can be done to stop this action.

"I have also been informed that an inquiry has been made from a firm of solicitors checking on the land at the back of addresses in Beckfield Lane."

She said residents were worried about rumours that houses were going to be built on the land.

I believe that erecting a fence is an often used method by those who may have an interest in the land ie they want to use it for their own purposes. It is intended to provoke reaction and aims to propel people into revealing rightful ownership. Not all land is registered and there are many reasons why it might not be. The builders are putting feelers out. I believe a legal person (solicitor/conveyanc
er) should be able to confirm that a good many years need to have passed where the current occupiers can prove they have not paid any rent etc for the property/land and that they have been seen to attend to the land and maintain it for the same several years. There are many internet sites giving guidance on how to claim unregistered land. Additionally the Land Registry will have information on their requirements on how to commence legal title in the event that there is no known owner.

What mystery? Hogg's did it! I'm off to fence off that abandoned house in Foxwood before someone else does.

I believe it takes 12 years to "claim" unused land,more likely its been done to show the land isnt used by the public.I havn't seen the fence(or land) but it could be hoggs are trying to aquire it as an access road.
